The reforms seek to ensure that the rights of patients are protected without absolving doctors and hospitals from accountability, says Dr R Muruga Raj.
Dr R Muruga Raj said the reforms proposed by the MMA to resolve disputes arising from high-risk medical procedures aim to acknowledge the legitimate concerns of all parties and provide them with closure.
FMT spoke to MMA President Dr Muruga Raj Rajathurai on proposed reforms for high-risk medical procedures.According to Muruga, the current practice is for the risks and potential complications of surgery to be explained in detail to patients prior to any procedure. Patients are allowed to seek clarification on any related matter before giving their consent. For children, informed consent is obtained from the parents.
Muruga says such a process is necessary as cases that go to court take a long time before they are resolved. The cost of care during this period could be costly, he added.“Under a no-fault compensation , the lawyers of both sides come to an agreement without assigning blame for the injury suffered to any particular party or to associate it with any particular reason.
