Rosmah Mansor claims the overlap breaches her fundamental constitutional right to a fair trial.
Rosmah Mansor’s application to strike out 17 charges brought against her under anti-money laundering and income tax laws will be heard before Justice K Muniandy on Dec 13.
The wife of former prime minister Najib Razak said her fundamental constitutional right to a fair trial will be breached if the prosecution proceeds on those charges. The filing was made in response to an affidavit by deputy public prosecutor Poh Yih Tinn on Sept 20 which claimed that all charges were within the parameters of the law.
She further said the Malaysian Anti-Corruption Commission had acted ultra vires its powers as it had no authority to carry out investigations for alleged offences under the Income Tax Act .“This is therefore, a clear case of abuse of power and consequently, the charges against me are mala fide,” Rosmah said in the affidavit.
