Industrial Court says the airline is obliged to ensure its pilots comply with the highest health and safety standards.
The Industrial Court upheld a pilot’s termination from employment in 2019 by AirAsia X on grounds that he suffered from anxiety.
Eswary said passengers entrust their lives to the airline, which has a duty to ensure that its pilots comply with the highest standards of health and safety. “Indeed, based on the contemporaneous evidence presented before this court, he was unfit to resume his flight duties,” she said. She said the additional training sessions were recommended and carried out as his performance did not meet the standards required of the company.
“The company could not treat the claimant’s fitness to resume flying, including his mental state, for fear of the safety of everyone on board,” she added. She said the claimant was once again informed in a meeting on Oct 15, 2019 that the continued issues related to anxiety could lead to termination.
